Terms & Conditions for SmilePurple
Effective Date: 21 July 2026
1. About These Terms
These Terms & Conditions ("Terms") govern your access to and use of the SmilePurple website, and your purchase of any products or customised resources from us. By placing an order, creating an account, or otherwise using our website, you agree to be bound by these Terms.
SmilePurple is currently operated as an independent business that has not yet been formally registered as a company, LLP, or proprietorship in India. Until formal registration is complete, “we,” “us,” and “our” refer to the individual(s) presently operating this business. This section will be updated with the registered legal entity name once registration is complete.
If you do not agree with these Terms, please do not use our website or purchase our products.
2. Who We Are and What We Offer
SmilePurple creates and sells activity books and learning resources designed for children with developmental and learning differences, including autism. Our products are intended to support parents, educators, and therapists in creating engaging, accessible learning materials.
Important: SmilePurple is not a medical, psychological, diagnostic, or therapeutic service provider. Our products are educational and developmental resources only, and are not a substitute for professional medical, psychological, or therapeutic advice, diagnosis, or treatment. Any customisation is based solely on information and preferences you share with us.
3. Eligibility
Our website is intended for use by adults — parents, guardians, educators, therapists, schools, and other authorised individuals — purchasing products on behalf of or for the benefit of a child. You must be at least 18 years old, or purchasing under the supervision of a parent or guardian with legal capacity to contract, to place an order with us.
4. Accounts
You may create an account to manage orders, save preferences, and track customisation history, or you may check out as a guest. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please notify us immediately at admin.smilepurple@gmail.com if you suspect unauthorised use of your account.
5. Products and Customisation
We make reasonable efforts to describe our products, including customised resources, accurately. However:
• Product images, colours, and layouts may vary slightly from the final product due to screen display or printing variations;
• Customised resources are prepared based on the information and instructions you provide — please review your customisation details carefully before submitting your order, as inaccuracies may affect the final product;
• We reserve the right to refuse or cancel a customisation request that we are unable to reasonably fulfil, or that contains inappropriate, unclear, or unlawful content.
6. Pricing and Payment
All prices are listed in Indian Rupees (INR) unless stated otherwise and are inclusive of applicable taxes unless specified. We reserve the right to change prices at any time, though changes will not affect orders already placed and confirmed.
Placeholder: SmilePurple does not currently process payments through an online payment gateway. This section should be updated to name the payment gateway(s) used (e.g., Razorpay, PayU, Stripe) once one is integrated, and to confirm that SmilePurple does not store card, UPI, or banking credentials. Until then, update this section to reflect however payment is actually being collected (e.g., bank transfer, UPI ID, cash on delivery).
An order is confirmed only once payment has been successfully received and you have received an order confirmation from us.
7. Shipping and Delivery
Because many of our products are customised to your child's specific needs, delivery timelines depend on the time required to prepare your order rather than a fixed dispatch schedule. We will share an estimated timeline at the time of order confirmation, and will keep you informed if preparation takes longer than expected.
Delivery timelines are estimates and may be affected by factors outside our control, including courier delays, incorrect address details, or force majeure events.
Placeholder: add specifics once finalised — delivery partner(s) used, shipping charges (if any), and whether you currently ship internationally or only within India.
Risk in the products passes to you upon delivery to the shipping address provided at checkout. Please inspect your order upon delivery and notify us promptly of any damage or discrepancy.
8. Returns, Refunds, and Cancellations
Because many of our products are customised to a specific child's needs, customised resources are generally not eligible for return or refund once production has begun, except where the product is defective, damaged in transit, or materially different from what was ordered.
Non-customised products may be eligible for return or exchange within a reasonable period of delivery, subject to the product being unused and in its original condition.
Placeholder: this section should be read together with (and should match) your separate Refund Policy once drafted — including exact return window (e.g., 7 days), who bears return shipping cost, and refund processing timeline.
9. Intellectual Property
All content on our website — including text, graphics, logos, illustrations, product designs, and the SmilePurple name and branding — is the property of SmilePurple or its licensors and is protected under applicable Indian copyright and trademark law.
Purchasing a product grants you a personal, non-exclusive, non-transferable licence to use that product for its intended personal, educational, or therapeutic purpose. You may not reproduce, resell, redistribute, or create derivative works from our content or products for commercial purposes without our prior written consent.
10. User Conduct
When using our website, you agree not to:
•provide false, misleading, or fraudulent information;
•use the website for any unlawful purpose;
•attempt to gain unauthorised access to our systems or other users' accounts;
•upload or submit content (including reviews) that is abusive, defamatory, infringing, or discloses another person's sensitive information without consent; or
•interfere with the proper functioning of the website.
11. Reviews and User Content
By submitting a review, rating, or other content to our website, you grant SmilePurple a non-exclusive, royalty-free licence to display and use that content in connection with our website and marketing. Please do not include identifiable details, photos, or diagnosis information about a child in a public review. We reserve the right to moderate or remove content that violates these Terms.
12. Third-Party Links and Services
Our website may link to or rely on third-party services, including payment gateways and courier partners. We are not responsible for the content, policies, or practices of these third parties, and your use of such services is subject to their own terms.
13. Disclaimers and Limitation of Liability
Our website and products are provided on an “as is” and “as available” basis. While we take reasonable care in preparing our products and content, we do not guarantee that our resources will meet every individual child's specific needs, and we make no warranty that the website will be uninterrupted or error-free.
To the maximum extent permitted under applicable Indian law, SmilePurple shall not be liable for any indirect, incidental, or consequential loss arising from your use of our website or products. Nothing in these Terms limits any liability that cannot be excluded under Indian consumer protection law.
14. Indemnification
You agree to indemnify and hold SmilePurple harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the website, or the information you provide to us, including customisation details.
15. Grievance Redressal
For any complaints relating to your order, these Terms, or our website, please contact us at admin.smilepurple@gmail.com. We aim to acknowledge your complaint within a reasonable time and resolve it as promptly as possible.
As required under the Consumer Protection (E-Commerce) Rules, 2020, once SmilePurple is formally registered, this section should name a designated Grievance Officer along with their contact details, consistent with the Grievance Officer section in your Privacy Policy.
16. Governing Law and Jurisdiction
Placeholder: confirm the city for jurisdiction — the draft below assumes New Delhi, matching your Privacy Policy contact address.
These Terms are governed by the laws of India. Subject to applicable consumer protection law (which may allow you to raise disputes at a consumer forum local to you), any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts at New Delhi, India.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business practices, legal requirements, or website functionality. The updated version will be published here with a revised Effective Date. Continued use of our website after such updates constitutes acceptance of the revised Terms.
